2. Definitions

The terms used in these Terms and Conditions shall have the following meanings:

• Shop – online service available at https://komisgastronomia.pl.
• Seller – the entity specified in point 1 of the Terms and Conditions.
• Customer – a natural person, legal person or organisational unit entering into a Contract with the Seller.
• Product – a movable item offered by the Shop.
• Order – a declaration of intent by the Customer to conclude a Sales Agreement.
• Sales Agreement – a distance sales agreement.

3. General provisions

The shop sells exclusively to businesses (B2B).
The Terms and Conditions do not apply to consumers.

1. The Terms and Conditions set out the rules for selling products through the Shop.
2. The Customer is obliged to use the Shop in accordance with the law and these Terms and Conditions.
3. Acceptance of the Terms and Conditions is a prerequisite for placing an Order.
4. The shop is conducted in Polish.
5. The prices listed in the Shop are gross prices (including VAT, where applicable).

4. Electronic services

1. The shop allows you to:
   a) place an Order,
   b) use the Shopping Basket,
   c) create an Account (optional)
2. Using electronic services requires: a device with Internet access, an active e-mail account, an up-to-date browser, and cookies enabled.

5. Placing orders and concluding contracts

1. Orders can be placed 24/7 via the Shop website.
2. Purchase process: add Product → customer details → select payment method → accept Terms and Conditions → place Order.
3. The Sales Agreement is concluded upon confirmation of the Order by the Seller via e-mail.

6. Prices and payments

1. All prices are presented in Polish zlotys.
2. Available payment methods:
   • traditional bank transfer to the Seller’s account,
   • Electronic payments Przelewy24 operated by: PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, KRS: 0000347935
3. If you choose electronic payment, you will be redirected to the Przelewy24 website.

7. Delivery

1. Delivery methods and costs are presented when placing an Order.
2. The delivery time depends on the availability of goods and the selected delivery method.
3. Due to the nature of commission sales and the size of catering equipment, delivery terms are agreed individually with each customer.
4. Delivery may be made by:
   – personal collection at the Seller’s premises,
   – the Seller’s own transport,
   – external transport (e.g. GlobKurier, InPost or other carriers).
5. The order completion time is between 7 and 14 working days, unless otherwise agreed.
6. The delivery cost is agreed individually with the Customer.

8. Complaints (conformity of goods with the contract)

1. The Customer is obliged to inspect the Product upon delivery.
2. Obvious defects must be reported within 7 days of receiving the Product.
3. The Seller’s liability under the warranty is limited to 12 months.

9. Protection of personal data

Personal data is processed in accordance with the Privacy Policy available on the Shop’s website.

10. Final provisions

1. In matters not covered herein, the provisions of Polish law shall apply.
2. The Terms and Conditions may be amended for important reasons. The amendment does not apply to orders that have already been placed.
